Activities will include the receipt of claims and to administer them through the contractual cycle, determining the entitlement to time and/or cost. Significant proactive engagement required with the project management team, other departments, customers and stakeholders to enable successful alignment of the recommendation and to adhere to the requisite processes, procedures and the critical activities required to achieve a conclusion for the successful completion of the project.Job Dimensions
  • Must produce a work product and ensure the same out of all team members to achieve management expectations.
  • Reviewing contract and drafting claims related correspondence, reports and presentations.
  • Engage as part of the project management senior team with other team members and the customer to develop and align strategy, methods and controls for the safe and successful project work performance.
  • Participate, as appropriate, in delivery related meetings, working with the area team and directly supporting the Area Contract Managers on the status and resolution of variations, claims and other commercial issues (contract close-out, etc.).
  • Self-performance of activities to support the programme objectives.
  • Team management, guidance and development to effectively resolve change events, claims and disputes fairly including coordination with Legal as may be required.
  • Performs and manages claims related matters to resolution, defining strategy and actions.
  • Team player that can direct and receive guidance and feedback.
  • Reports to the Claims Director.
Job DutiesInterface / Leads/ provide advice as required to contracts and commercial teams and be responsible for:
  • The implementation of Contract & Commercial Management Procedures for the administration of claims.
  • The review of Contract general terms and conditions to highlight areas of risk, ambiguities, conflicts or deviations from the scope of work and the actions required.
  • The development and management of appropriate mechanisms to monitor compliance with contract terms and conditions.
  • Working with the other Project Team members to ensure that Bechtel and customer related actions or inactions which could result in contract changes or claims are identified and to provide recommendations accordingly.
  • Identification and resolution of Contract claims as they develop, including engagement of corporate legal department where necessary.
  • Experience in forensic analysis of programmes and engagement with the planning / project controls teams.
  • Contractual procedural requirements.
  • Determination of contractual entitlement and compensation of for Extensions of Time and disruption.
  • Definitive understanding and application of disruption, mitigation, acceleration and global claims assessment.
  • Experienced in presentation of delay events and critical/ longest path analysis.
  • Assessment of time and cost entitlement.
  • Experience of assessment and methodologies of disruption analysis utilising productivity-based and cost-based methods including, measure mile, earned value, and windows analysis.
  • Familiar with the guidance of SCL and AAECI techniques and procedures.
  • Coordination and interface with the delivery teams of the EPM and Contractor.
  • Development of recommendations with the claims teams.
  • Assessment of submissions by the Contractors on multiple contracts and analysis of details and particulars required to make appropriate assessment and determination of claims.
Qualifications/Experience
  • Essential Technical Skills: Degree in Business, Quantity Surveying, Law or Engineering desirable.
  • 20+ years of relevant experience in commercial and/or contracts management on mega-programmes/ projects, including within a PMC/ Contractor and/or Client delivery environment.
  • Experience and courses in pricing, contract law, contract drafting, administration and negotiation of change orders, effective correspondence, planning and scheduling.
  • Demonstrated leadership and teamwork capabilities suitable for managing a large team of many nationalities and backgrounds.
  • Proficiency in the formation and administration of major infrastructure projects.
  • Comprehensive knowledge of contract management and negotiations gained through education or experience.
  • Extensive commercial management knowledge.
  • Demonstrated capability to prepare and make presentations to Customers, Line Managers, Project Managers and project teams.
  • Knowledge of when to engage legal counsel.
  • Working knowledge of engineering/construction industry contracting practices, applicable government and commercial regulations and practices, and Bechtel policies, procedures and work practices.
  • Extensive skill in working and communicating effectively, both orally and in writing, with other project functional groups, Customers and Stakeholders.

  • Excellent communication and interpersonal skills required.
  • Coaching and mentoring skills required for knowledge transfer to colleagues to develop competency in the understanding of claims administration.
  • Self-motivated individual with good leadership skills and experience and the ability to influence without authority.
  • Ability to manage priorities and take on additional evolving responsibilities with demonstrated experience providing direction/supervising a team.
  • Ability to work within an integrated Client/Bechtel team at multiple levels of seniority. Ability to work within a culturally diverse organisation, recognising and respecting differences.
  • Professional Engineer (P.E.) or Professional Membership (MRICS, MCIOB, AACE, PMP).
  • Relevant experience on infrastructure-based projects, such as site preparation, site development and civil, Infrastructure and buildings projects.
  • Must be knowledgeable in various construction fields such as civil, structural, electrical, mechanical, telecommunications, rail etc.
