Job Description

Parsons is looking for an amazingly talented Senior Commercial Manager to join our team! In this role you will get to manage all contract and commercial activities for a Program, Project, Organization, division, or a major Department.He manages the contractual activities related with any kind of Project for the pre-tender, and post tender (execution) phases, the handover and full Project close-out .What Youll Be Doing

  • Manage efficiently the Contract/Commercial Department of the Project
  • Review and provide a substantiated report with the resolution for Claims and Disputes and Variation Orders
  • Create and establish processes, procedures and standards governing the Contract/Commercial Department
  • Prepare Contracts and Agreements, Commercial Deals
  • Check commercial deals related with the procurement
  • Provide weekly and monthly reports on the Projects contractual status
  • Represent the Client and the Consultant
  • Review and approve the Interim Payments, Payments Certifications (Contractors and Consultants, Vendors and Suppliers) on behalf of the Client
  • Create and maintain register (with the help of his teams) for Cash Flows, Bonds, Retention, Insurance, License and Business Registration data
  • Issue of Practical Completion/Taking Over and Final Completion Certificates
  • Advise on Scope gaps, orders not placed and provisional sums relating to any contracts.
  • Assist in the preparation and production of tender documents, including all appendices, annexes and tender addenda required
  • Prepare, with his/her teams, a Schedule of Preliminaries / Employers Requirements for incorporation with the Tender Documents.
  • Issue tender documentation and instructions to tenderers.
  • Train his team and colleagues and transfer knowledge and report the progress of his team
What Required Skills Youll Bring
  • Manage all contractual aspects of a Project from the inception (business case) up to the final close out.
  • Analyze, evaluate, and manage project finances, contracts, as well as assuring commercial performance against established schedule, budgets, and other critical project data.
  • Overseeing and managing a large number of separate Projects Contracts
  • Establishing and maintaining procedures and processes related with the Contract and Commercial Management.
  • Establishing and maintaining Contractual and Claim Registers
  • Review, analyze, diagnose Contractors Claims. Prepare the Claim Report with the proposed resolution based on the Projects Contract, Countrys Laws and Clients legitimate interests
  • Review existing contracts and identify risks and contractual terms not conforming to project policy and procedures.
  • Collect all the information and ensure that the resources are available for dealing with all contractual issues and claims.
  • Realize the critical data and describe accurately the current situation.
  • Recognize the hidden or possible contractual and financial issues.
  • Forecasting, based on his experience, of possible contractual implications.
  • Draft a Contract or a Commercial Deal taking under consideration the Clients legitimate interests, the governing laws and the fairness criteria for all parties.
  • Be proactive and forecast terms and conditions for the mutual gain of the parties.
  • Create and add value in agreements.
  • Negotiate with different parties on an efficient and productive manner and method.
  • Resolute conflicts with sustainable agreements
  • Protect the Clients interests and advising him appropriately and accordingly on an ethical basis.
  • Provide guidance, direction, and specialized assistance to project team for the resolution of project commercial and contracts related issues,
  • Oversee the commercial performance of assigned project areas to ensure project commercial procedures and objectives are maintained.
  • Sharing best practices and continual improvement techniques with staff, monitoring, and reporting to senior management concerning compliance with client business objectives.
  • Attends regular meetings with the required people for contractual and commercial issues.
  • Provide critical project updates/ reports and presentations.
  • Interface with the Clients team as required
  • Manage a Contracts Administration Team
  • Manage a Commercial team (Quantity Surveyors), procurement, including subconsultants
  • Supervise the operations of the Cost Department
  • Advice the Client or the Project Director, present, and report status of the programs commercial and contract wellbeing.
  • To make an evaluation of Risk Assessments
  • Review and evaluate the projects progress, Planning Schedules, Critical Paths, S-Curves
  • Apply the dominating country laws in the construction industry.
What Desired Skills Youll Bring
  • Bachelor of Science degree, as minimum, in Contract Management, and/or Quantity Surveying, Commercial Management, Construction Law, Procurement and Finance, or related technical/business field from an accredited internationally recognized university.
  • Qualified and Chartered by a recognized international body such Royal Institution of Chartered Surveyors (RICS), Chartered Institute of Building (CIOB), Chartered Institute of Arbitrators or other internationally recognized similar institution.
  • Experience exceeding twenty (20) years, with at least fifteen (15) years working for large international construction engineering consultancies and/or construction companies.
  • Must possess:
  • Experience of managing large projects/programs, preferably within the Entertainment sector.
  • Negotiation of Prime contracts and management thereof, including management of international consultants and/ or contractors.
  • Proven claims background (knowledge of SCL Delay and Disruption Protocol and/or Arbitration/ Dispute Resolution).
  • Ability to develop strong working relationships with staff, client, and third-party teams, interface and coordinate project performance with other disciplines, interpret and deliver clients vision, and proactively manage project processes and requirements.
  • Ability to manage complex work situations, and where required negotiate to resolve contractual issues.
  • Strong written and oral communication skills in English and interpersonal/ management skills.
  • Arabic speaker will be appreciated.
