Background The legal consultant will provide services by this contract related to procurement practices in Jordan and will cover technical topics including funding modalities for vaccines, procurement best practices including framework agreements, competitive negotiation, direct international procurement, and registration. The legal consultant will work in coordination and collaboration with the MTaPS ? Results for Development (R4D) consultant, identify relevant legislative implications and stipulations in laws, bylaws, and related instructions, and then provide practical legislative recommendations and feedback relative to the technical areas listed above. The legal consultant will also work directly with the National Vaccines Procurement Modernization Committee (NVPMC) as required.Description of Services to be provided The legal consultant will provide services by this contract related to procurement practices in Jordan and will cover technical topics including funding modalities for vaccines, procurement best practices including framework agreements, competitive negotiation, direct international procurement, and registration. The legal consultant will work in coordination and collaboration with the MTaPS ? Results for Development (R4D) consultant, identify relevant legislative implications and stipulations in laws, bylaws, and related instructions, and then provide practical legislative recommendations and feedback relative to the technical areas listed above. The legal consultant will also work directly with the NVPMC as required.The consultant will undertake the following activities:1. In coordination with the consultant to support the implementation of procurement best practices and sustainable funding for vaccines in Jordan, analyze the legal and policy environment relative to potential vaccine funding modalities (national level), their requirements and describe their implications to the Jordanian legal and institutional context for the development of the ?Funding Modality Options Analysis (FMOA) Report.?2. Participate in presenting the ?FMOA Report? to stakeholders including the NVPMC.3. For the recommended funding modality, provide the legal inputs and legislative recommendations needed for the implementation of the recommended funding modality in accordance with the Jordanian legal and institutional context including legal risks and mitigation measures.4. In coordination with the consultant to support the implementation of procurement best practices and sustainable funding for vaccines in Jordan, analyze the new Government Procurement By-law (GPB), budget disbursement and other related laws and guide the development and finalization of ?Framework Agreement (FA) Implementation Guidelines? according to existing public procurement laws and procedures. This activity includes meeting with national stakeholders in the MOH, GPD, MOF, and other entities.5. In coordination with the consultant to support the implementation of procurement best practices and sustainable funding for vaccines in Jordan, provide legal guidance and support the development and review of the drafted instructions and procedures regulating negotiations during public procurement. This activity includes meeting with national stakeholders in the MOH, GPD, MOIT, and other entities.6. Contribute to the development of technical material for the MTaPS Procurement Training Curriculum in coordination with the consultant to support the implementation of procurement best practices and sustainable funding for vaccines in Jordan and participate as a trainer in the implementation of the training to different stakeholders.7. Provide technical assistance to the consultant to support the implementation of procurement best practices and sustainable funding for vaccines in Jordan with legislation and policies governing direct international procurement in and procurement of and bidding for vaccines not registered and/or WHO pre-qualified.Deliverables or MilestonesFor the development of the ?Funding Modality Options Analysis Report?: (8days)1. Technical brief (max 10. pages) summarizing the analysis, inputs/feedback, and guidance on the legal aspects of the proposed funding modalities and their requirements and implications to the Jordanian legal and institutional context. -For the development of the ?Funding Modality Implementation Plan?: 2. Outline with legal inputs and specific legislative recommendations, including drafting of legal language needed for implementing the recommended funding modality, in accordance with the Jordanian legal and institutional context including legal risks and mitigation measures. - 2 days3. Technical brief (max 10 pages) on the support for providing guidance on the legal provisions and implications required for the development and review of the FA Implementation Guidelines - 7 days4. Technical brief (max 5 pages) in outlining the legislation and policies regulating negotiations during public procurement and guiding the development of the Instructions for Competitive Negotiation - 2 daysFor the Procurement Training Curriculum: (18 Days)5. PowerPoint presentation (max 15 slides and 20?) on the Government Procurement Bylaw.6. Training material on the legal content of the framework agreement7. Training material for ?negotiation,? ?direct international procurement,? and ?fair competition? covering the legal aspects -8. Technical brief (max 5 pages) on the legal analysis and guidance provided on the legislation and policies regulating direct international procurement and bidding for vaccines not registered and/or WHO pre-qualified. - 3 days 9. Meeting minutes for meetings with key stakeholders and MTaPS as required.- 10 daysConsultant qualification requirements: ? Bachelor?s or master?s degree (preferred) in law, public health policies, or related field.? At least 5 years of experience in legislations related to procurement processes with special focus on pharmaceutical procurement process.? Excellent knowledge of local and international procurement legislations and best practices.? Possession of logical thinking with strong analytical and systematic skills.? Prior experience in providing technical assistance to government agencies in LMIC preferred.? Prior experience working with USAID-funded projects preferred.? Excellent written and verbal communication skills in English is required and Arabic is preferred.? Advanced skills in Microsoft and Google suite of products.? Ability to organize work with minimum supervision.? Ability to prepare and review reports, SOPs, training materials, documents and presentations. ?
